Setting up a potential Supreme Court showdown, the US Court of Appeals for the 5th Circuit struck down an SEC-approved Nasdaq rule requiring corporate boards of the over 3,000 companies on the exchange to implement diversity quotas on the basis of race, sex, sexual orientation, and gender identity. The 51-page opinion found the rule violated the Securities Exchange Act of 1934, exceeding the authorities of the Commission, which is meant to protect “investors and the American economy from speculative, manipulative, and fraudulent practices.” And while the rule is manipulative, the decision seems obvious: the SEC exists to regulate the exchange of securities, not board members’ exchange of bodily fluids. A Marxist product manager with chewed up bangs and oversized glasses (you know the ones) might get away with pushing these policies at random failing startups, but in the big leagues? Money talks, and woke bullshit — legally speaking — walks.

Lily Phillips, a 23-year-old British woman, achieved infamy on X this week after clips from her documentary went viral in which she reacted to getting “run through” (her words) by 100 men in 14 hours. Phillips, who had the on-camera mien of someone pulled from a Syrian dungeon, confessed to a YouTuber that she had to “dissociate” during her experience (no shit). Generally, the feeling online was something catastrophic happened to this girl from which she would never recover, and the search for “reasons” began. Prominent radical feminist Julie Bindel blamed… the men she invited to sleep with her, and argued they should be in jail. Others blamed sexual liberation, OnlyFans, the internet itself, and maybe it’s a bit of all of this. But it’s also just a symptom of modernity, as well as yet another example of the West’s collective suicide, this time death by degradation. Anyway, enjoy your night in

Yesterday, Fortune reported Donald Trump’s upcoming presidential administration is the wealthiest in American history, with a combined net worth of $474 billion. This comes after The Economist sounded the alarm that “The PayPal Mafia is taking over America’s government,” citing a recent Christmas party organized by PayPal alumnus David Sacks and the All-In crew, where attendees were “celebrating Donald Trump’s victory” and “women were woefully underrepresented in the audience… one female entrepreneur walked out in disgust at the ‘male energy.’” Nice. Couple thoughts: 1) If you can’t even be in a room around members of the opposite sex without being offended by their mere “energy,” consider psychiatric help. 2) Are you seriously expecting me to be bothered that our government is about to be run by literally the most successful people in the country?
